SELECTMEN’S  MEETING

JANUARY 17, 2005

 

PRESENT:      Denise Lindahl; Paul Rooney; Ed Moran; Bill Magruder; Barbara O’Leary          

 

ROAD COMMISSIONER:

Due to a storm Bill will be leaving early and gave the following report.  Salt is almost gone and sand is low.  He requested buying more salt right away.  He suggests building a shelter over the salt area.  Denise asked if there are any grants available to build a salt shed?  The old sand will be mixed with the new salt to stretch it out.  The material will be delivered to Rt 1 since you can’t get a tractor-trailer into the pile.  The selectmen reminded him the account is overdrawn and no purchases can be made till the new fiscal year starts February 2, 2005.  Bill will then haul it up to the pile.  He will line up a delivery for 2/2/05.

 

Denise asked if he had heard from Ashley Landry regarding the letter sent concerning the re-direction of the road and the lighthouse and plantings encroaching into the road.  Bill has not heard from him and neither have the Selectmen.  

 

There is a car in the road near the Whitings blocking the plow from getting down the street.  Bill is not sure if it belongs to the Whitings or someone at the church.  Paul and Denise reminded him a notice had been put in the paper regarding keeping cars 10’ from the road to let plow and emergency vehicles pass.  It was recommended to put a note on the car that it must be moved and if it is not it will be towed at the owners expense.  A copy of the notice that was in the paper will be put on the vehicle as well.

 

School Bus.

Denise spoke with Mitch at the bus garage.  The reason the bus did not go further down the road is the Nichols told the driver he could no longer turn around in their driveway.  He now turns around at the Radcliff’s house, which is just a short walk for the kids.

 

CDGB

The Selectmen received the last requisitions for funds from the CDBG.  John Fancy also requested money from the town of over $19,000 for Bluff Road.  Denise asked Bill is this was part of the project.  It was the understanding of Denise and Paul that Bluff Road was not part of the water and sewer project.  Bill agreed, he did not think the portion the Town was paying included any work on Bluff Road.  Dense said she would call John Fancy to check on this.  It was AGREED no payment would be made until this is cleared up.

 

ACO:

Raymond Tucker reported Alfred Bonin’s horse had to be put down after it fell and broke its hip.  Several complaints came in from people who saw the horse lying down in the field.  Raymond was called and had to put it down. 

 

There was a call of a dog running deer.  The owner says it isn’t his dog; the people moved away and left it behind.  He took the dog in and has had it for 6 months.  Ray told him since he has taken on the responsibility of the dog, feeds it and brings it in the house, the dog is his.  If the Wardens find out the dog is running deer he will be find.  The dog has also chased the neighbor’s kids.  He was told to keep the dog chained in the yard or find it a home.  Raymond have him a warning for dog-chasing deer and a dog at large.  The Selectmen recommended giving a summons if this continues.

 

Raymond has asked that Jerry Tucker be appointed Assistant ACO.  After Raymond’s recent heart attack he felt it would be best to have a back up.  The Selectmen AGRRED to appoint Jerry Tucker Assistant ACO.  He will attend classes to become certified and be used if Raymond can’t follow up on a complaint or is sick.  Once Jerry is certified, a fee schedule for next year will be discussed.

 

DOT/GATEWAY 1

The DOT cancelled its meeting today with the Selectmen due to the bad weather.  Ashley Landry was not notified of the cancellation and came to the meeting.  Denise stated she thought they were going to give a presentation on more than just curb cuts up Rt 1, but also address development, business, driveways etc.  Curb cuts apply on Rt1, not Rt52, up to Calais.

 

Ed stated the maps at Mid Coast Regional Planning already show the changes and this seems to be informational for the Towns.

 

Mr. Landry then stated he received the letter from the Selectmen and would like to respond.  He apologized for encroaching on the Town road.  He will move the loam pile back and put the road back to what it was, weather permitting.  The trees and plantings have been there for 10 years and feels they are probably not in the road.  3’ from his house is the road.  Denise said the Town has a grant to help determine the Town’s Rights of Way and measures will be taken to return these to the Town where residents have encroached them.  Mr. Landry stated there is a RoW issue in Temple Heights and this grant should help that.  The deeds for the Spiritualist camp say they have authority of RoW.  He questioned how properties with wells and septic systems on RoW would be addressed.  Denise stated the first step is determining where all the Town RoW are, and then proceeding from there. 

 

There is a water problem that needs to be addressed here.  A study is being done in the spring to address Shore Road and its many problems.

 

Mr. Landry gave a brief history of land he purchased from Lynn Hayward and Dick Parsloe.  It’s a half acres he hopes to build a house on.  There is access to High Street, which was given up by Mr. Parsloe in the deed.  Mr. Landry would like a Warrant article at the Town Meeting where the Town surrenders it rights to this section of High Street.  The road is no longer used and is a paper road according to Mr. Landry.  Denise suggested he contact Bill Kelly to see if a warrant is needed.  If a warrant is required it must be handed into Barbara by mid March to be included in the Town Report for the Town Meeting in May.

 

A proposal will be put together for the Selectmen to review.  This will cover burring under Mountain Street to get water to his house.  He owns the land on both sides of the road and has a drilled well getting 55gal/min.  He would like to run a pipe under the street to get to this well.  Bill Magruder will be contacted on his plans and proposal and Frank Therio, CEO also.  The Selectmen did not seem to think this would be a problem, but asked to see the proposal.  This is work that will be done in the spring.

 

Mr. Landry asked to be notified when the DOT reschedules their meeting.

 

OTHER:

Denise and Barbara received notice from the State Auditors office they want to do an audit.  The Selectmen and the Clerk both felt this was not necessary.  We will have the annual Town Audit in March and this covers State requirements.  Denise will call our Auditors and see if this is required.  At the Waldo County Selectmen’s Meeting, other Towns felt this was not required.

 

Denise has received a letter from End Of Life, a hazard waste company, asking if the Town is interested in their business.  We currently have Environ who hauls away electronics from the Dump.  End of Life is from Portland but services this area.  They haul for the School district and Winterport.  Denise will get the cost of the waste material to be hauled away for a comparison.  New rules for taking household waste went into effect and Tim will be going to classes on how to handle the waste and what the new rules are.

 

Ed Moran presented a liquor license renewal for the Hideaway Diner.  This will be posted in the paper for discussion at the next meeting on 2/7/2005.

 

Barbara O’Leary received a quote for new computers and a maintenance program from Abacus Computers.  The cost of 3 new computers seems high.  The Selectmen suggested getting a price for maintenance and troubleshooting, with the Town purchasing computers on its own.  This could be put in the budget for next year.  Invite Ben Cameron to the next meeting.  Ed suggested calling Dell to see if we can get any deals by upgrading.

 

 

The $10,000 CD for the Marine Harbor Fund will be combined with the $20,000 approved at the Town meeting.  This will be changed into a 7 day CD, which enables the Town to use the money without being penalized.

 

Vicki Eugley faxed a list of items to be cleaned up for year-end.  The Selectmen addressed these items.  See attached.

 

Ed Moran suggested looking for people to form a committee to look into pulling out of the district.  He volunteered to start this committee and be the Chair until the committee gets going.  Barbara will put a notice in the papers.
