Board Meeting Minutes July
10, 2008 PRESENT: Craig Poulin, Chairman; Paul Rooney; Denise Lindahl; Jack Driscoll, Town Administrator; Amon Morse, Road Commissioner; Peter Allen, NVC Representative; Barbara O’Leary, Town Clerk Citizen

Nealey and Mike Vellaro were present to address a letter received from the Code
Enforcement Officer, John Larson. The
letter was in regards to two Stop Work Orders on the property at Mr.Vellaro stated he has not been able to reach Mr. Larson and contacted Jim Nealey, the Chairman of the Planning Board, to see how to proceed. Craig Poulin stated these are new businesses and would fall under the Site Plan Review Ordinance voted in at Town Meeting in May. Paul Rooney recommended Mr. Vellero attend the Planning Board Meeting Tuesday night since the Chairman said he could get him on the agenda. It was agreed Mr. Vellaro would attend the meeting and ask for assistance in filling out the necessary building forms and applications. Mrs. Marilyn D’Agostino was present to discuss violations at her property. She requested Mr. Driscoll not be present since they have an unfavorable relationship. Mr. Poulin stated Jack Driscoll is the Town Administrator and works on behalf of the Board, as well as the Town, and will be present during the discussion. She stated issues with her property go back to 2001 with a dispute between her and a neighbor regarding a right of way. Paul Rooney said both he and Denise Lindahl were on the Board and are aware of the issues. Mrs. D’Agostino stated the RoW issue with her neighbor also involved shore land zoning violations. Over the years she has sent letters to the Code Officer asking for a Plan of Execution to correct the violations but never received one. Mrs. Lindahl asked if Mrs. D’Agostino is aware of shore land zoning violations, why she committed a SLZ violation last week by a delivery of gravel on her front yard, which is within SLZ. Mrs. D’Agostino replied the gravel was brought in to fix the well but she was not here to discuss that. She also stated any work she has done on her property has been after discussion with her brother, who works with the DOT, and is knowledgeable in these areas. Mrs. Lindahl asked what Mrs. D’Agostino would like the Board to do. She would like a plan put in place to correct the violations the Town says she has. Paul Rooney stated she must meet with the CEO and agree on a plan on action to correct the various violations on her property. He further stated the violations must be corrected since the fines continue to grow. |
